Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Bylinki platform, operated by Bylinki Limited, a company incorporated under the Companies Act, Cap. 212 of the Laws of Tanzania. By creating an account or using our services you agree to be bound by these Terms.
1. Definitions
- "Platform" means the Bylinki website and any associated mobile applications.
- "User" means any individual or entity that accesses or uses the Platform, including Job Seekers and Employers.
- "Job Seeker" means a User who registers to search for employment opportunities.
- "Employer" means a User who registers to post job listings and recruit candidates.
- "Content" means any text, data, information, images, or other material submitted to or available on the Platform.
2. Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts under the Law of Contract Act, Cap. 345 of the Laws of Tanzania to use this Platform. By registering, you represent and warrant that you meet these requirements.
3. Account Registration and Security
You agree to provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at support@bylinki.com if you suspect any unauthorised use of your account.
Bylinki reserves the right to suspend or terminate any account that contains false, misleading, or fraudulent information.
4. Employer Obligations
- Employers must comply with the Employment and Labour Relations Act, No. 6 of 2004 and all subsidiary legislation thereunder.
- Job listings must be genuine, lawful opportunities. Misleading, discriminatory, or fraudulent listings are strictly prohibited.
- Employers may not discriminate against applicants on grounds of sex, marital status, race, religion, ethnicity, disability, or any other protected characteristic under Tanzanian law.
- Employer accounts are subject to verification by Bylinki administrators before listings become publicly visible. Bylinki may revoke verification at any time.
- Employers must not use applicant data for any purpose other than evaluating candidates for the specific role advertised.
5. Job Seeker Obligations
- Job Seekers must ensure that all profile information, CVs, and application materials are accurate and truthful.
- Submitting false qualifications or fraudulent documents may result in immediate account termination and may constitute an offence under the Penal Code, Cap. 16.
- Job Seekers are solely responsible for verifying the legitimacy of employers and job offers before sharing sensitive personal information outside the Platform.
6. Prohibited Conduct
You must not:
- Use the Platform for any unlawful purpose or in violation of any applicable Tanzanian law or regulation.
- Post or transmit any content that is defamatory, obscene, or harmful as defined under the Cybercrimes Act, No. 14 of 2015.
- Scrape, harvest, or otherwise collect data from the Platform without our written consent.
- Attempt to gain unauthorised access to any part of the Platform or its infrastructure, which may constitute an offence under the Electronic and Postal Communications Act (EPOCA), Cap. 306.
- Post listings for pyramid schemes, multi-level marketing (where unlawful), domestic servitude, or any form of forced labour.
- Collect or solicit application fees from Job Seekers in violation of the Employment and Labour Relations Act.
7. Intellectual Property
The Bylinki name, logo, design, and all Platform Content produced by Bylinki are the exclusive property of Bylinki Limited and are protected under the Copyright and Neighbouring Rights Act, Cap. 218. You may not reproduce, distribute, or create derivative works without our prior written consent.
8. Limitation of Liability
To the fullest extent permitted by law:
- Bylinki does not guarantee employment outcomes or the accuracy of any job listing or applicant profile.
- Bylinki is not a party to any employment contract formed between an Employer and a Job Seeker.
- Bylinki shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
9. Dispute Resolution
Any dispute arising out of or in connection with these Terms shall first be referred to mediation. If mediation fails, the dispute shall be submitted to the jurisdiction of the courts of the United Republic of Tanzania, in accordance with the Civil Procedure Code, Cap. 33.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania. Where these Terms are silent, the relevant provisions of Tanzanian law shall apply, including but not limited to the Law of Contract Act, Cap. 345, the Electronic Transactions Act, Cap. 442, and the Consumer Protection Act, No. 2 of 2008.
11. Amendments
Bylinki may update these Terms from time to time. We will notify registered Users of material changes by email or in-platform notification. Continued use of the Platform after the effective date of any change constitutes acceptance of the revised Terms.
